1. Bulletin from our club president.
On 7 October 2023 we were presented with a claim for monetary damages from a well-established and reputable German-headquartered company that specializes in obtaining compensation from intellectual property theft (e.g. copyright infringements) because of the actions of an ipernity member. He is now a past member because his account was promptly deleted along with the image that had been uploaded without the photographer's permission as required by the Digital Services Act (DSA).
When we received notification, we were instructed to make payment of EUR553.29 / USD587.65 no later than 20 October 2023. This is the third time I had to work with this company, which I hope is the last. Fortunately we again came to an amicable resolution and the claim was withdrawn because of legal considerations and our prompt action.
At the same time, in the best interests of the site and spirit of cooperation and to fulfill legal requirements, I provided all pertinent information about this member so this company could better pursue their claim. Know that when one deliberately chooses to commit illegal acts such as intellectual property theft, their interests are subordinate to those of the community and all members in good standing, which I and the rest of the team serve.
As a reminder, while some may consider such acts as innocent and harmless, they are in fact serious with real legal consequences that violate our 'Guidelines of Good Conduct' and 'Terms of Use'. This understanding is imperative since intellectual property laws, especially with regard to digital platforms like ours, remain dynamic in the European Union, subject to change by future court decisions. So, in conclusion, if an image is not yours or if you have doubts it meets the requirements to be a derivative "original" creation, just say, "No" and do not upload it.

2. Option for setting 'Unknown' photo creation date.
As a viewer you may now see 'Taken:' date displayed as "--/--/----". Rather than the user having to set some inaccurate guess, they can use this option. It is found on the popup box from the '(change)' link beside the date. Due to the restrictions of the existing programming, the user who wishes to set an 'unknown' date, does still have to enter a valid date, but being 01/01/1800 it is not onerous.
3. Homepage pictures for the winter season.
In just under four weeks, the motifs on our homepage will switch to the winter season. You may help with the selection again by voting on the former pictures. You will find a link to the voting there: Winter Pictures 2022/23.
On this occasion, we ask you to check your hard drive for appropriate new picture proposals. Besides typical outdoor winter motifs, indoor shootings are also very suitable: Portraits, still life, macro shots, atmospheric shots with candles, cups with hot drinks (chocolate, grog), pets, board games, books in cosy reading places, and so on. Was ist ein "photo sharing club"? Das meint wohl, dass man speziell ausgewählte Bilder aus seinem Portfolio einer Öffentlichkeit darbietet.
Bei mir ist das so: um überhaupt etwas "sharen" zu können, muss ich mir zuerst einen Überblick über meine Bilder machen. In den letzten 5 Jahren hat nicht nur die rein quantitative Menge, sondern auch die Zahl der Geräte, die diese Bilder erzeugen zugenommen, so dass es nur noch praktikabel erscheint, diese Bilder online zusammenzuführen, zu sichten und zu ordnen. Sonst würde ich komplett die Übersicht verlieren.
Im Hinblick auf den bei Ipernity vorhandenen, begrenzten Speicherplatz die Bilder entweder nach dem Upload zu löschen oder vorher klein zu rechnen, ist mir vollkommen unpraktikabel.
Ich bin daher dazu übergegangen, ALLE Bilder zuerst auf flickr zu laden. Denn da gibt es (momentan noch) unbegrenzten Speicherplatz. Von dort dann ausgewählte Bilder noch ein weiteres Mal auf Ipernity zu laden, habe ich in letzter Zeit nur noch sporadisch gemacht. Ipernity ist bei mir momentan nur noch ein Archiv. Schade eigentlich.
Kurzum, so ein Hinweis, der eine Schere im Kopf fordert ("Überleg Dir gut, was Du hier hochlädst."), bewirkt bei mir nur das Gegenteil. Ich glaube auch, dass es nicht in die Landschaft passt und uns mehr schaden wird als nützt. Die Strategie aller anderen Plattformen ist doch, die Leute so viel als möglich hochladen zu lassen, um sie möglichst stark zu binden. Oder nicht?

J'ai été confrontée à ces actes (pas sur ipernity), le gérant d'un blog a utilisé mes photos et les photos d'autres photographes sans demander aucune autorisation. J'ai essayé de le contacter, plusieurs fois il y a quelques années, peine perdue. Une mouche m'a piqué, j'ai indiqué sur une de mes photos que ce site volait mes photos. Il a déposé plainte, il a perdu en première instance et en appel !
C'est très pénible de se trouver convoquée au commissariat de police puis d'être obligée de se déplacer au tribunal du lieu ou se trouve l'entreprise en question et c'était à des centaines de kilomètres de chez moi.

In unserer Vereinssatzung liest man in Artikel II, Abs. 1: "Der Zweck des Vereins ist es, seinen registrierten Mitgliedern eine Webseite zur Verfügung zu stellen, die das Hochladen und Speichern von Fotos, Bildern, Videos oder anderen Dateien, für welche die Mitglieder das alleinige Urheberrecht haben, sowie das Schreiben von Blogs ermöglicht, um diese Inhalte öffentlich zu teilen, oder wahlweise auch nur privat mit Angehörigen und Freunden."
Also: Photo-Sharing ist: Hochladen, speichern, teilen (öffentlich oder privat).
2. Wer bezahlt den Spaß?
Der Betrieb einer Webseite kostet Geld. Da wir ein großer Verein sind, sind unsere Kosten entsprechend hoch. Laut Finanzbericht für das Jahr 2022 betrugen sie insgesamt 33.924 €, wovon 25.944 € Serverkosten waren, unterscheidbar in Fixkosten (Servermiete) und variable Kosten (Speicherplatzkosten pro Terabyte Datenvolumen). Gedeckt werden unsere Kosten allein aus den Mitgliedsbeiträgen. Andere Einnahmen hat der Verein nicht.
3. Die zahlenden Vollmitglieder tragen die Kosten für die Gastmitglieder
Wie Du in Artikel 5, Abs. 2 der Satzung lesen kannst, ermöglicht unser Verein kostenlose Gastmitgliedschaften. Diese werden von den zahlenden Vollmitgliedern subventioniert. Die Festlegung des Nutzungsumfangs war Gegenstand intensiver Diskussionen und Abwägungen. Nachzulesen ist dies in den Varianten für die Nutzung von ipernity.
4. Die Kostenbelastung durch Gastmitglieder muss im Rahmen bleiben
Um die Belastung der Vollmitglieder nicht ausufern zu lassen, haben Gastmitglieder begrenzte Kontingente. Dies ist bei Flickr und anderen Fotogemeinschaften genau so. Spannend ist allerdings die Frage, was zu tun ist, wenn Vollmitglieder ihre Mitgliedschaft beenden. Die wenigsten tun dies ordnungsgemäß, indem sie ihre Daten löschen und die Gemeinschaft damit von den Speicherplatzkosten entlasten. Die überwiegende Mehrheit lässt den Datenmüll einfach stehen. Und damit komme ich zu dem Screenshot, auf den sich Deine Frage bezieht. Er bedeutet nichts Anderes, als dass aller Datenmüll nach 6 Monaten gelöscht wird. Es ist einfach nicht zu verantworten, dass sich wieder ein Berg von -zig Terabyte Datenmüll ansammelt, der nur Geld kostet, aber zu nichts nutze ist, weil dieser Content unsichtbar und unzugänglich in dem von uns gemieteten S3-Bucket beim Amazon Web Service schlummert.
Du mietest ja auch nicht eine Lagerhalle für den Sperrmüll ehemaliger Freunde oder verstorbener Verwandter an, die größer ist, als Deine eigene, von Dir genutzte Wohnung, oder?
Diese Regelung ist übrigens nicht neu, sondern schon ein paar Jahre alt. Der jetzt von Dir hinterfragte Hinweis im Uploadfenster ist nur eine Erinnerung daran.
5. Wie machen andere Dienste das?
Zunächst einmal ist festzustellen, dass alle Dienste die Rechte von Gastmitgliedern einschränken. Denn alle haben dieses Kostenproblem. Professionelle Anbieter haben allerdings den Vorteil, dass sie auf unternehmensinterne Quersubventionierungen zurückgreifen können. Google kann beispielsweise nahezu unbegrenzten "kostenlosen" Speicherplatz anbieten, weil es ihn durch Werbeeinnahmen subventioniert.
Die defizitäre Plattform Flickr wurde am 20. April 2018 von Yahoo an SmugMug abgegeben, einem Unternehmen, das sich auf das professionelle Hosting von Bildern spezialisiert hat. Dort verdient Smugmug das Geld, das es bei Flickr verbrennt. In den 5 Jahren danach gab es bei Flickr ähnliche Sanierungsmaßnahmen wie bei ipernity. Es ist keineswegs so, dass nicht zahlende Gäste bei Flickr unbegrenzt hochladen und speichern dürfen. Ich habe dort selbst einen Gastaccount. Meine Möglichkeiten sind stark eingeschränkt. (Ich nehme an, Du hast einen kostenpflichtigen pro-Account bei Flickr?)
6. Was unterscheidet eine Cloud von einer Foto-Sharing-Plattform?
Wer eine möglichst günstige Cloud sucht, findet diese am ehesten dort, wo große Konzerne (Google, Apple, Adobe, etc.) die Kosten intern subventionieren. Diese Clouds haben aber durchweg den Nachteil, dass sie nicht die speziellen Bedürfnisse von Fotografen im Hinblick auf die Kommunikation mit Anderen erfüllen. Es ist kein Problem, viele Gigabyte irgendwo kostenlos zu hosten. Aber was habe ich davon? Nicht viel, denn die gesamte Kommunikation mit anderen Fotografinnen und Fotografen fehlt - das Sharing.
7. Abschließende persönliche Bemerkung
Dass Du alle Deine Fotos bei Flickr hostest, verwundert mich. Ich persönlich finde es viel praktischer, sie auf dem eigenen PC zu haben und mit Lightroom zu verwalten. Damit kann ich sie perfekt vorbearbeiten, taggen, sortieren, wiederfinden und gegebenenfalls mit anderer Software nachbearbeiten, ohne dass ich sie aufwändig wieder runterladen muss. PC hochfahren, und los geht's. (Außerdem herrscht bei Flickr ein totales, abtörnendes Chaos im Hinblick auf die Gruppen.)
Zu ipernity, Flickr, der FOTOCOMMUNITY oder anderen Plattformen, bei denen ich Mitglied bin (Facebook, Bergsteigerforen etc.) lade ich nur hoch, was ich öffentlich machen will. Das ist weniger als 1% meines Bilderbestandes. Aber ich will Dir nicht reinreden. Wenn es Dir besser gefällt, Deine Bilder in fremden Händen aufzubewahren, ist es Deine Entscheidung. Mir wär das viel zu unsicher und zu kompliziert.
Es mag womöglich auch bessere Software für die Bilderverwaltung geben, als Lightroom. Aber es kostet mich keinen Cent zusätzlich, weil ich es zusammen mit Photoshop abonniert habe, einer Software, die für mich der Goldstandard unter den Bildbearbeitungsprogrammen ist.
Bergfex club has addedIch kenne keine einzige Cloud oder anderen Sharing-Service, die einen solchen Service bieten. Und so ist es bei vielen ipernity-Features. Das macht unsere Plattform einzigartig. Deshalb bin ich hier, und nicht woanders.

Ich habe Zweifel, ob dieses Konzept des "Sharings" so zentral für Ipernity sein sollte. Wenn Menschen Fotos "sharen", dann tun sie das wohl auf Instagram.
Meine Strategie wäre eher: "Komm her mit all Deinen Fotos. Hier sind sie gut aufgehoben. Richte Dich ein, sieh Dich um und wenn Du magst, teile Deine Welt mit anderen."

Bergfex club has replied to Realbeck clubUnd außerdem: Wir haben nicht die Wahl. Ipernity wurde 2007 als Sharing-Seite aufgesetzt. Wir haben sie übernommen, wie sie ist. Da wir alle nur Fotografen sind, keine Programmierer, wären wir außerstande, etwas wie Instagram auf die Beine zu stellen. Aber wir sind ja auch hier, weil wir genau so das lieben, was ipernity bietet. (Stell Dir vor: ich habe gar keinen Insta-Account.)

Estic d’acord en que al peu de la finestra per pujar imatges consti una advertència al respecte dels drets d’autor d’una imatge. Però veig absolutament innecessari el missatge dins la finestra advertint que Ipernity és un Club de compartició de fotografies i no pas un servei d’emmagatzematge, i la resta d’advertiments al respecte del que implica la no renovació del servei fins a l’anul·lació del compte.
Penso que cadascú fa un ús d’Ipernity a la seva conveniència:
1) Pot compartir fotos temàticament amb altres membres
2) Pot confegir el seu arxiu personal de fotografies.
3) Pot fer visibles o no les seves fotografies a la resta de membres.
4) Pot optar per penjar fins a 100 fotografies amb un límit de 250 MB totals i 2,5 MB per foto i no pagar cap subscripció.
5) Pot optar per tres diferents subscripcions que permeten arribar a un límit de 250 GB de capacitat.
De tots aquests serveis que diferencia realment Ipernity d’altres plataformes operatives a la xarxa?
Tinc la impressió que es vol donar una imatge que no s’ajusta exactament a la realitat del club.
Quants usuaris membres del club tenen a la vegada algun altre compte en altres plataformes (Flickr, 500px, Instagram i altres...)? I perquè?
Que n’esperen els usuaris d’Ipernity del futur del club?
Com aconseguir que creixi el nombre de membres del club?
Tinc la sensació que el club creix molt lentament i que, bàsicament, s’envelleix progressivament.
Això crec que és el que, a mi personalment, em preocupa i no gens si Ipernity és un club de compartició o un servei d’emmagatzematge.
Crec realment que ipernity és un club de persones almenys amb un nexe comú: la afecció a la fotografia, però no el club de fotografia online no comercial més gran del món.
Amb tot, crec que les tasques de manteniment i el treball de l’equip son elogiables en tots els seus vessants.
PS: Sé que la meva opinió té molt poca vàlua i que no serà ben apreciada pel col·lectiu. Disculpeu-me per això. Ben cordialment.

I agree that at the bottom of the window for uploading images there is a warning about the copyright of an image. But I see absolutely unnecessary the message in the window warning that Ipernity is a photo sharing club and not a storage service, and the rest of the warnings about what is involved in not renewing the service until the cancellation lation of the account.
I think that everyone makes use of Ipernity at their convenience:
1) You can share photos thematically with other members
2) You can set up your personal photo archive.
3) You can make your photos visible or not to other members.
4) You can choose to upload up to 100 photos with a limit of 250 MB total and 2.5 MB per photo and pay no subscription.
5) You can opt for three different subscriptions that allow you to reach a limit of 250 GB of capacity.
Of all these services, what really differentiates Ipernity from other operating platforms on the network?
I have the impression that they want to give an image that does not exactly correspond to the reality of the club.
How many members of the club have other accounts on other platforms (Flickr, 500px, Instagram and others...) at the same time? And why?
What do Ipernity users expect from the future of the club?
How to get the number of club members to grow?
I have the feeling that the club is growing very slowly and that, basically, it is getting progressively older.
I think this is what worries me personally and not at all whether Ipernity is a sharing club or a storage service.
I really believe that ipernity is a club of people with at least one common link: photography addiction, but not the largest non-commercial online photography club in the world.
All in all, I think that the maintenance tasks and the work of the team are commendable in all its aspects.
PS: I know that my opinion has very little value and will not be well appreciated by the collective. Excuse me for that. Cordially.

Team club has replied to homaris clubI understand your thoughts on the warning message on the upload page. Unfortunately we regularly receive help tickets from past club members who have either not renewed their memberships, or have been absent for over 3 years, returning and being frustrated and upset that all or most of their images no longer exist on our website. We continually have to report that loss to those people, and would love to never have to explain that to anyone ever again. Not only is it hard on those people, but it also sends them off with a negative experience with our club and that isn't good for us either. So the message is an attempt to make the policies about this very obvious to everyone. That makes such a message necessary. (If you have a suggestion for a different way to make our policies about this stand out for everyone, we would be happy to consider it.)
You speak of many of the concerns that the team is aware of and that the team also works on and hopes for solutions. For example, you can see from the most recent board meeting (found here: www.ipernity.com/doc/team/52170732 ) - that the board is indeed thinking about the future of the club, and how to grow the number of club members. Though the board does concern itself with the issues, we are very small in number and for long term success we need anyone who is able to help.
Do you have a suggestion as to how we can find out answers to your questions? Maybe you could start a group and invite your contacts to a discussion about them? If members have concrete ideas they are willing to support implementing, they can bring those ideas to the team. Members have every right to take action themselves.

Selbst die Sonderaktionen (mehrjährige Abonnements) wurden von nur 15 % der Club-Mitglieder angenommen. Der überwiegende Teil der ipernity-Mitglieder war nicht bereit, eine Neuprogrammierung zu finanzieren. Dabei hätten 100 Euro pro Mitglied ausgereicht (Stand 2018, basierend auf einer Kostenschätzung der Firma Quellcode, Paderborn). Schade.

Bergfex club has replied to Kalli clubWhen I joined more than a decade ago I did so with the intention of posting edited music from the past century to date with background information and in as many categories as possible. That I achieved. I was not looking for a spot to simply upload files. Incidentally when a non-member currently discovers Ipernity there is a section titled “Join Us” where the future member is encouraged to “upload videos/music”.
It would be appreciated if the reader would go to my docs and, if you did that, may understand that the posts are of a primarily educational and secondly entertainment nature. As an older individual this form of research and the ability to share have become an integral part of my life. The majority of these docs were initially downloaded from my personal music collection, YouTube and other legitimate sites.
The latest concern over copyright is understandable from the perspective of your administration but I strongly feel that my side is of equal value.
Should you find it necessary I will delete my thousands of posts.
If you find this obligatory, please describe how I may do this in the most efficient way.
It’s my hope to continue posting. I am too old for a court battle.

Onthoud dat ipernity een fotodelingsclub is, geen cloudopslagdienst
Laat gebruikers zelf bepalen waarvoor zij Ipernity binnen de ‘gekochte’ ruimte gebruiken. Deze benadering kan er zelfs toe leiden dat betalende leden hun account opzeggen.
Als je vergeet je betaalde lidmaatschap te verlengen, wordt inhoud boven de gratis 100 items verwijderd
Ik neem toch aan dat in die gevallen leden een email ontvangen met de consequenties van het niet verlengen. Zo ja, dan is deze mededeling op deze plaats overbodig.
Inactieve accounts worden na 3 jaar volledig verwijderd
Hier boven lees ik dat deze accounts tweemaal via email worden geïnformeerd. Lijkt mij voldoende. Als een account 3 jaar niet wordt gebruikt, wordt vast en zeker de upload pagina ook niet gebruikt en is deze tekst dus overbodig.

I don't think the texts at the upload page come across as "customer-friendly" at all. I can imagine they even put off new users.
The whole approach comes across as rather negative to me.
Remember that ipernity is a photo-sharing club, not a cloud storage service
Let users decide what to use Ipernity for within the 'purchased' space. This approach may even cause paying members to cancel their accounts.
If you forget to renew your paid membership, content above the free 100 items will be deleted
Surely, I assume that in those cases, members receive an email with the consequences of not renewing. If so, this notice in this place is redundant.
Inactive accounts are deleted completely after 3 years
I read above that these accounts will be notified twice via email. Seems sufficient to me. If an account is not used for 3 years, surely the upload page will not be used either, so this text is superfluous.

This will keep people from being able to download your images. While there are ways for people to pirate photos on the internet, this option makes it difficult.
In a perfect world, yes, all photos would have full exif etc. However, one can lose EXIF when copy, or edit has happened. Therefore there isn't any way for us to require everyone's photos to inlcude that information. ipernity does retain any of that information that is uploaded to the website. Anyone who is capable of pirating an image could also simply remove such information from the file, but as stated, ipernity keeps anything that is there when uploaded.
We appreciate the frustration of unapproved downloading of images, and do not condone it. I hope that the knowledge about how to set your account to block normal downloads is helpful for you.
